McClellan Statement on Alito’s Stay on Mifepristone Restrictions

Washington, D.C. – Today Congresswoman Jennifer McClellan (VA-04) issued the following statement after Supreme Court Justice Samuel Alito issued a temporary stay on restrictions to mifepristone access in the Alliance for Hippocratic Medicine v. FDA case: 

“Justice Alito’s decision to issue a temporary administrative stay preserving access to mifepristone is good news in the continued fight for reproductive freedom; however, FDA approval and Americans’ access to mifepristone is still under threat. The lower court rulings limiting or outright banning access to mifepristone are unprecedented and recklessly undermine the FDA’s authority. 

“Politicians should have no part in the reproductive health decisions Americans make. These are deeply personal choices that Americans should be making in consultation with their health care providers. Mifepristone remains safe and effective for medication abortion, and these lower court rulings are blatantly based on ideology, not science. 

“I will always fight to protect reproductive freedom and leave health care decisions – including abortion and miscarriage management – to patients and their providers. I was proud to sign onto an amicus brief with over 200 of my congressional colleagues urging the Court to preserve access to mifepristone. We cannot allow these widespread attacks on Americans’ reproductive freedom to stand.”
