Washington, D.C. – Today, Congresswoman Jennifer McClellan (VA-04)’s bill, H.R. 5243, unanimously advanced out of the Energy & Commerce Committee to the House floor for a vote as part of H.R. 9393, the Lower Costs, More Transparency Act of 2026. McClellan’s bill requires Medicare Advantage plan providers to submit enrollee-level data on supplemental benefits to the Department of Health and Human Services (HHS). This requirement will increase transparency around supplemental benefits to help seniors choose the best plan for their needs.
“Seniors deserve the most up-to-date and accurate information about the benefits and providers available to them when making health care coverage decisions. Yet a lack of data around Medicare Advantage supplemental benefit plans leads too many people to make decisions that don’t fully meet their needs,” said Congresswoman McClellan. “This lack of transparency also weakens our ability to assess whether these Medicare Advantage plans provide adequate care. My bill will make it easier for seniors to personalize their health care choices and improve their health care outcomes. I thank the Committee for its consideration and advancement of this bill, and I urge my House colleagues to bring it up for a vote as soon as possible.”
Nationally, over half of eligible Medicare beneficiaries are enrolled in Medicare Advantage plans, which can choose to offer benefits not covered under Original Medicare. However, there is no requirement to specifically report on supplemental benefits or their utilization.
McClellan’s bill mandates reporting on data on eligibility for supplemental benefits, the types of benefit categories offered, and utilization of and payments for supplemental benefits. It also requires HHS to publish the data annually with appropriate patient confidentiality safeguards in place.
